Terms of Service

By creating an account, publishing a profile or otherwise using Pakar, you form a binding contract with us under the Contracts Act 1950 and agree to be bound by these Terms and all policies referenced in them. If you use Pakar on behalf of an organisation, you represent that you are authorised to bind that organisation.

You must be at least 18 years old and legally capable of entering into a contract to use Pakar. You are responsible for ensuring your use of the service complies with all laws that apply to you.

You must provide accurate, current and complete information and keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised use or security breach.

Profiles are private drafts until you request approval and an administrator approves them for publication. We may approve, decline, request changes to, or later unpublish any profile at our discretion, for example, where content appears inaccurate, misleading, unlawful or in breach of these Terms. Approval is not an endorsement or verification (see clause 7).

You retain ownership of the content you submit to your profile (“Your Content”), and your intellectual property rights are protected under the Copyright Act 1987 and other applicable law. By publishing Your Content, you grant Pakar a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and distribute it for the purpose of operating, promoting and improving the directory.

You represent and warrant that you own or have the necessary rights to Your Content and that it does not infringe the rights of any third party or breach any law.

The Pakar name, logo, design, software and all other materials we provide (excluding Your Content) are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from them without our prior written consent.

Pakar is a self-service directory. We do not verify, vet, endorse, certify or guarantee the identity, qualifications, credentials, claims or conduct of any professional listed on the platform. Listings are self-reported. Any engagement, agreement or transaction you enter into with a professional is solely between you and them, and you are responsible for your own due diligence. Certain features are offered on a paid “Pro” plan. Where you purchase a paid plan, the applicable fees, billing cycle and features will be presented to you before purchase. Fees are payable in the currency stated and, unless required by law or expressly stated, are non-refundable. Nothing in these Terms limits any non-excludable rights you may have as a consumer under the Consumer Protection Act 1999. We may change our fees on reasonable prior notice.

You agree not to:

• post content that is false, misleading, defamatory (within the meaning of the Defamation Act 1957), obscene, harassing, hateful or otherwise unlawful, including content prohibited under the Communications and Multimedia Act 1998 and its Content Code;
• impersonate any person or misrepresent your affiliation, qualifications or credentials;
• scrape, harvest or collect data from the platform, or use contact details for unsolicited marketing or spam;
• attempt to gain unauthorised access to, disrupt or interfere with the platform or its security; or
• use Pakar for any unlawful purpose or in breach of these Terms.

We may suspend, restrict or terminate your account or remove content that we reasonably believe violates these Terms or the law, or that may harm Pakar, its users or third parties. You may stop using Pakar and delete your profile at any time from your dashboard.

The platform is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free or secure.

To the fullest extent permitted by law, Pakar and its operator will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or business, arising out of or in connection with your use of the platform or any dealing between you and a listed professional. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including certain rights under the Consumer Protection Act 1999.

You agree to indemnify and hold harmless Pakar and its operator from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from Your Content, your use of the platform, or your breach of these Terms or any law.

These Terms are governed by and construed in accordance with the laws of Malaysia. You agree to submit to the exclusive jurisdiction of the courts of Malaysia in respect of any dispute arising out of or in connection with these Terms or your use of Pakar.

We may update these Terms from time to time. We will revise the “Last updated” date above, and continued use after changes take effect means you accept the updated Terms. See also our Privacy Policy. Questions? Contact us via our homepage.
